Our Experience:

  • We represented the client in proceedings to execute an order of the English Courts against the debtor’s assets in India; as well as in ancillary proceedings arising out of the execution proceedings. We also successfully represented the client along with his English counsel in negotiations and in drawing up the final settlement agreement for payment of the principal sums.
  • The Firm is currently advising its client on the enforcement of judgement of the High Court of Tanzania and its implications on continued legal proceeding before courts in India.
  • The Firm actively advised UK’s leading vehicle finance company with asset tracing services for potentially enforcing the UK Court’s judgement against an Indian resident.
  • The Firm has previously advised on enforcement of judgement of a Court of Appeal in Dubai against its client in India.
  • The Firm is helping a German client to enforce the Order of inheritance and succession issued by the Courts in Germany to assist its clients to recover assets in India based on the Order of the German Courts.
  • The Firm represented the Republic of India in two significant investment treaty arbitrations and extensively advised the Republic of India when it was threatened with coercive enforcement action.
  • As a first in India, the Firm obtained a favorable Enforcement Order from the High Court of Karnataka which allowed parties foreign to Indian jurisdiction to enforce International Commercial arbitration Awards passed in countries that are signatory to New York Convention and that are reciprocating territories with India.

Yes, a foreign judgment can be enforced in India, but the process depends on whether the judgment is from a "reciprocating territory" or a "non-reciprocating territory". For reciprocating territories, the judgment can be enforced directly in India as if it were an Indian court decree, while for non-reciprocating territories, a fresh suit needs to be filed in India based on the foreign judgment.
